These terms govern your use of Ember. Using Ember means you accept them. If you do not accept them, do not use Ember.
Who provides Ember
Ember is operated by an individual based in New York. Ember is not a bank, a broker-dealer, a money transmitter, or a registered investment adviser.
Who can use Ember
You must be 18 or older and a resident of the United States. Ember is offered in the United States only and is not directed at anyone outside it.
Ember is in private beta and accounts exist by invitation. Each account is for one person. Do not share your sign-in credentials, and tell Ember at privacy@emberfinance.app if you believe your account has been accessed by someone else.
Ember is not financial advice
Ember shows you your own financial records and performs arithmetic on them. Nothing in Ember is investment, tax, legal, or accounting advice, and nothing in it is a recommendation to buy or sell any security.
Balances, cost basis, gains, net worth, and every other figure Ember displays are derived from data you or your bank supplied, and they can be wrong. Ember is not a system of record. Your bank, broker, and tax documents are. Check anything that matters against them before you act on it, and consult a qualified professional for advice about your situation.
Ember is in beta
Ember is under active development. Features can change or be removed, the service can be unavailable, and defects can cause incorrect figures or data loss. Ember is not a backup of your financial records.
Download your data regularly. The export produces a ZIP of CSV files and is linked from the Accounts page.
Price and billing
Nothing is billed today. Ember publishes prices on the pricing page for when billing opens, and those prices can change before it does.
If billing opens, Ember will ask for your agreement before charging you. Ember will not charge a payment method for an account created during the free beta without that agreement.
Your data
Your financial data is yours. Ember claims no ownership of it and uses it only to operate the service for you, as described in the Privacy policy.
You are responsible for what you put into Ember, including that you have the right to import it.
Bank connections
Bank connections are provided by Plaid and are read-only. Ember cannot move money. Your use of Plaid is also subject to Plaid's own terms and privacy policy, and Ember is not responsible for Plaid's service.
Your bank's own agreement with you governs your accounts. Connecting an account to Ember does not change it.
Acceptable use
Do not use Ember to break the law, to access an account that is not yours, to attack or overload the service, to scrape it, or to resell it. Do not connect a financial account you are not authorized to access.
Ember may suspend or close an account that does these things.
Ending your use
You can stop using Ember at any time. To close your account and delete your data, write to privacy@emberfinance.app. See the Privacy policy for what is removed and what is kept.
Ember may suspend or end your access, with notice where practical, if you breach these terms or if Ember stops operating. If Ember stops operating, you will be given notice and time to export your data.
No warranty
Ember is provided as is and as available, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. Ember does not warrant that the service will be uninterrupted, secure, or error free, or that any figure it displays is accurate.
Limit of liability
To the fullest extent the law allows, Ember is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost data, or financial losses arising from decisions made using Ember.
To the fullest extent the law allows, total liability for any claim relating to Ember is limited to the greater of the amount you paid Ember in the twelve months before the claim, or one hundred dollars.
Some states do not allow these limits, so they may not apply to you.
Changes to these terms
If these terms change, the effective date above changes with it. A material change will be sent to the email address on your account before it takes effect. Continuing to use Ember after that means you accept the new terms.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in New York.
